If you are to lazy to read those convos. I made a logo, a site, and AIM icons for a band. They dont give me any credit. Now they are selling T-shirts with My logo on it. I saw 6+ people today with Oddmanout shirts on..with my logo. no "J.D.'03" at the bottom corner, nothing. No credit on the site anymore, they took it down a month after I mdae the site.So i get no credit, money (I don't really care about the money, but now that I know I am not getting credit even, I kind of want SOMETHING) They don't even ask to use the logo I made them they said "You said we could use them" I said "yes, with credit, give me credit" I get a F*** you etc... If you have the time, read the convo's more in detail...

anyway, WHAT SHOULD I DO?!?!

The thing is, this band is a highschool band. Some of the mebers go to my school. Many fans are in the school. I don't want to get harassed by everyone. They have a concert tommorow, they are selling the shirts there too. They are popular in the state, enough to sell out. So I don't want people rioting at me or something. I'm 15, how can I get a lawyer? And if I did, takeing it to court? I would be made fun of for ages! I don't want that. I'd get beat up and stuff. You see my problem?

They're being so-much-better-than-thou w***ers. If it was your design, you should have been credited for it, even if they did maul it up. I know I would have. But really, what's so bad about having a small signature on the bottom of a logo?

Do you have logs of previous conversations regarding the logos? If you had someone as a 'referee' and both parties were mature enough to settle something, then by all means try. If they're just going to be w***erish and dismissive like that, I suggest firebombs or Molotov cocktails.

Ahh...after thinking about it, I guess it only makes sense that they'd go to your school.

I don't suppose he's interested in sharing profits huh? I would, but I'm not him.
Of course, I would've given credit to begin with anyway, and then we wouldn't have this bs prob.

The only other thing I can think of at the moment (besides legal action) would be to tell everyone that you made the logo. You might seem kinda silly doing it, but it's still true. But I still see the other loser coming along and saying you stole it from his site (or whatev). In any case, this is probably gonna get a bit messy.

I think a major part of the problem here is that they don't understand any of what's going on here.

The first guy didn't understand what the hell you wanted, and why you wanted it in the first place. He also didn't understand the concept of copyrights in the first place.

This is just wrong. I'm pretty sure that anything you create has some form or another of copyright on it. And you never gave up your rights to the logo like he said. He has no idea what the hell he's saying.

My point is that making a logical and fair agreement with these guys is not going to be easy.

On the bottom of the site it said "Thanks to Jon Del Sesto for makeing our logo's and site" then he deleted it.

I would drop it and move on. You shouldn't be doing work for idiots like this. Did you by any chance make backups of all your work? If so, wait until they get big, and then get yourself a lawyer. They will have to pay you royalties I would think, if your case is proven. I know you're not after money, only recognition, but they seem to need a good lesson in common decency. The only thing that hurts idiots like this is their pocketbook.

Ok, here's my awesome plan :P:

1) Make a new super-awesome website design/logo

2) Take a screenshot of the design

3) Embed a watermark in the screenshot

4) Send them the screenshot

5) See how well they cope trying to rip that one.

Did you actually have the logo & site copyrighted, or did you just say write "copyright" somewhere on it?

Just saying it's copyrighted doesn't make it legeal. In fact, you could get into serious trouble that way.

No..you couldn't...Even if I just said "I made this, it's mine. I made it." or "Jon Del Sesto, he made this. His stuff" All the same. They can't use it. If I put (c)J.Del Sesto 2003, there is nothing wrong with that.

Dogs--that's perfectly fine. You ever been to elfwood? They have a statement saying "All of the work here belongs to the residents who make it" or something to that effect. If you state that you made it, and that it's copyrighted to you, it IS copywrited.


On second though, DA has something like that too, I believe.

Basically: Any unique piece of art you make, be it a picture, a design, a poem or a book, it is instantly comprighted and protected during your entire life plus 70 years after your death, unless you give someone else the rights to your work OR you state it as public domain (like stock photography).

Wow, they sound like dangerously illiterate morons.

Anyway if you have evidence that it's your work you can get them on it...if not I'd drop it. Sometimes it's just better to just cut your losses than go make things worse. At worst you've learned an important lesson and won't make the same mistakes dealing with people like that in the future.

You could probably get a lawyer and settle it out of court. If they want to challenge then that's when it would go to court I think.

You guys are right. I was thinking of registering a copyright. My mistake.
That said, I think it would be a good idea to register the copyright on both the website and the logo - it's to your advantage, and that way they can't put an earlier copyright date on it and say it was theirs first... yours would be registered either way. (I think)

So I did a little research for you.
Section 106 gives the owner of the copyright exclusive rights. Furthermore:
Section 106A(1)(a) states "The author of a work of visual art shall have the right to claim authorship of the work.

There's probably more, but my eyes burn from reading through all the legal crap... plus I have to get to a jam session.

SAJN is entirly right, It's his logo and his site design, No matter what the final site design looked like it was based in part or whole on his design, confront him in public some time and give him a law-textbook.

Like it was said anything you create yourself is your work, if you can prove it, take it to court, stick up for the little man, don't get screwed over.

I know a littlebit about copywrites now from squidi.net, a person to makes sprite comics using sprites he designed and draws freehand, not sprites he takes from games, he's shut down several sites and forums for taking his artwork and modifying or using it regually without his permission.

If you gave the logo to them with the stipulation that you have your name on on, on paper or via a verbal contract, it's legaly binding, unless you outright said to the person "here, I designed this logo and site, use it how you like" you've got a case me thinks, if you agreed they could use if as long as you were credited to the work, you can go far.

They already said they won't remove it, so your only choices are

a) talk to them and convice them to give you credit back
B) sue their butts and get your credit plus money
C) talk to their ISP or webhost, provide proof of a copyright infringment and have them shut down their internet service/webhosting

But they also can't prove that you didn't make them, because you could obviously show that you could make what you made.
