reminds me of german tank commanders: they used to have throat mikes (obviously they spoke audibly though) to cut out the noise from the rattling and the engine and guns etc...

Prosecuting someone for a "hate crime" is not for what they did. That was obviously already illegal. It prosecuting them for what they thought.

Wookie: No, it's prosecuting them for the motivation behind their action. Think about the difference between murder and manslaughter. Also, note that someone who hates a group of people to the degree that he attacks a random member is much more likely to commit a similar crime again than someone who got mad in a bar and broke a bottle over someone's head.

Okay, well a serial criminal that may have murdered victims in the course of a robbery is no less a threat than some one that may have killed someone because he was gay. In my opinion they should both be treated for the crime they committed. Not for what they were thinking when they did it.

edit - again let me add that I was being abit sarcastic in the initial post here so we don't need to continue the debate. I am against designating certain crimes hate crimes though because I think it is an unneccessary redundancy. To me all crimes of extreme levels such as rape or murder are crimes of hate.

Again, as Ictus pointed out, there's a difference between involuntary manslaughter and premeditated murder. Should a man who accidentally killed a pedestrian with his car receive the same capital punishment given to a person who deliberately ran down a person?

The same principle applies to differentiating between hate and other crimes.

all this does is predict what we say before the signal reaches the mouth. The electric signal probably takes a longer time to get proseced in the computer than the time it takes for the signal to reach the mouth and lungs.

I never said death caused by accident or negligence should be be treated the same as premeditated murder. That's dumb.

Raising the level of a crime because of what you thought when you were doing it and calling it a "hate crime" is unnecessary. If I murdered someone to steal his wallet or murdered someone because he's white, I still murdered someone. And then who's to determine which crimes of hate classify? They're all crimes of hate but apparently they seem to mostly apply to those acted out against some "minority" group.

I dislike how the term "racism" has been thrown around, but a man who kills blacks for being blacks is a more dangerous person than a man who gets 25 for killing a man in a bar fight or for sleeping with his wife.

If you'd go as far as to kill the people you have decided to hate, you are past the point of possible remorse, and perhaps beyond conventional rehabilitation.

There is a difference between hate and anger. Anger is a quick burst, hate takes time and choice to develop, and dies hard.

On the other hand, I think it's stupid when prosecutors go out of their way to prosecute as a hate crime because someone heard ethnic slurs being used during a fight or something. But that may be part of the term "racism" being overused.

You just contradicted yourself. First, you said deaths caused by different motives should not be treated the same, then in the same breath, you say that it's "unnecessary" to do so.
