Not sure how it works where she lives, but here if you walk on the railroad tracks you can be cited for trespassing. That isn't public land the tracks are built on, it's private property and she has no right to be there.

And to have the audacity to complain after being hit by a train and surviving. You should thank who or whatever you believe in, apologize to the train company and move on.

Well, I could forgive the lawyer if he required a hefty legal fee beforehand, and is now laughing his *** off because he knows that this person is amazingly stupid, and isn't going to get anything, and he'll be getting a thousand or so bucks for the comedy.

Am I the only one who's disturbed by some of the responses here? Wishing a brutal death for her?

Yeah, it's dumb, but it's nowhere near the dumbest lawsuits. This one is mild in comparison.

I actually do think that signs should be posted somewhere that a railroad is in use. Some people might assume that it's not or something.

The abuse of the legal system and the stupidity of people in this world, I believe, is sufficient to warrant death for some.

Anyone with common sense ougth to be able to figure it out. When the top of the track is rusty, it's not in use. When the top of the track of shiney (not rusty), the tracks are used by trains.

There was a similar case in Germany, where a man crossed the railroad in his car without looking, because the barrier wasn't lowered. What he didn't realise was that it was broken and there was a train comming that hit the car. In this accident he lost his kids and his wife who were with him in the car.
He wanted to sue the railroad-company because they didn't supply a working barrier. That didn't work. Instead the company sued him because he damaged their train. The company won the case because trains always have the right of way before any other road users and the St Andrews cross that is on every railroad-crossing indicates that - even without the barrier working.

I suspect that this case will be similar. Although it is not so sad when she loses.
