Any company found using spywhere without telling the installee could be fourced to pay a fine, etc. However, msot spywhere is alread told to the user, just buired in terms and policies, or an EULA. still, it's a step in the right direction.

It's a good idea but the problem is the same than with anti-spam laws - over 90% of it is from outside the US.
