Is this legal?

I ordered a product from one Internet Vendor (Music Vendor), and received an e-mail from them today...

"Hello

We are going to fill your next order for the ----------------. We have been told and seen recently that you are "badmouthing" our company and employees.

If you want to order from us, that is fine, but if you are going to continue to talk negative about us, we will not be able to fill your orders in the future and will ask you to go elsewhere.

Agreed? Let me know if you have any questions. "

Pretty much, what it is referring to is that I said on another forum (I guess they visit) that I don't shop from them much anymore since they take a long time to ship and their prices fluctuate and are relatively high.

Can they legally say that they won't sell me a product because of an internet posting?

FTC violation or something?

I believe a business can refuse service to anyone they want, regardless. Personally, I'd go rag on them some more for actually telling you all that just for criticising their service.
<Lyme> I got Fight Club for 6.98 at walmart.
<Black_Bishop> I am Jack's low price guarantee

They're trying to blackmail you into keepin your mouth shut. In this case you have little to lose, so I'd definately keep it up. Even file a report with the BBB if you can.

As would I.

E-mail them back, asking them if they can accept consumer criticism. Also ask them if they look up on all of their consumers to see what they do on other internet sites? Maybe you should ask them why their prices fluctuate and they're late on sales? Post the resulting e-mails, and bill them for the PR.

Make sure you get your package and then post the very same email wherever you posted you're earlier criticism.

Explain that....

A good company would bring it up and seek to find ways to resolve it and make you a happy customer.... instead they're just bitter....which makes me think that they give alot of people poor service.

That seems unprofessional for a silly forum post.
2006-06-05, 8:22 AM #8
Yeah, really the post I responded to was a "Where do you shop from?" thread. Some guy stated his complaints for this vendor - and other people started posting about their experiences too. So I know there's definitely some bad history here...
2006-06-05, 8:50 AM #9
What is the company? I'm sure we'd all like to avoid them.

If you're ordering imports, complaining about price and ship time might be a little much. Imports are going to be more expensive, and they might have to get their hands on the actual CD when you order. But, they could do better to inform you of this. It would make for better public relations.

Based on the e-mail they sent you alone... they suck, really really bad.

They're within their rights to sell or not sell to whoever they want, for whatever reason. Not a very effective way to get you to stop, though, since you can always buy from someone else. I suspect the people running this business just aren't all that smart.

The solution is obvious.

"Very well, cancel my order then. I'll be sure to post your e-mail publically so any potential customers of yours will be warned how they'll be treated. Thanks."

Legally no. They can't refuse service based on race, religion, sex, etc. but they can say **** off if you badmouth them.

And Cool Matty, you're coming with me. Cuff 'im.

No, I understand that imports are going to be higher. But there's other vendors out there like The End Records, LaserCD, etc - that get the same CD's and charge lower rates. The only benefit of this vendor is they get some items others don't - and they get them faster in stock from Europe.

However, as an example - they charged $110 for the new Sonata Arctica CD/DVD Japan edition. It was limited and sold out - but that is just way higher than even the import rates.

Then the best thing is to take your business elseware. Hurt them where it counts, in the pocket.

No, they can't. Those signs you see have no legal grounding.

Well I checked online and it looks like there is legal backing for refusing to serve - as long as its not for racial or discrimation reasons.

For imports, go to borders.com or to Silver Platter, its a store that speciallizes in imported cd's, but I don't know if they have online orders.
"You're only supposed to blow the bloody doors off!" Anyone who recognizes this quote is awsome.

You'd have to proove that the business refused service because of race, gender, etc, and that would be very hard to do unless you had a recording of someone saying "I'm not serving you because you're a cracker".

Simple solution: Order someplace else.

Yes it's legal.

Give me a call, I'll say that I represent their company and you can go shove it, cracker.

You forget that you basically don't have any rights on the internet.

Yeah, like Avenger said - they have to prove it's racist/sexist et.

You (despite any real motive) can just point blank refues service and say it's because you don't feel like it (if you want).

All trading is (by definition) voluntary: I can't demand to buy anything from anyone, they have to want to sell it.
