Long story short:

Roomates moved out 3 months early. We signed a 1 year contract. They refused to pay since we were "forcing" them out. (note: they were moving out at the end of may anyway. The only use the apartment would have been was parties)

So they got their way and didnt pay rent for the summer. They chipped in some money, and said it was alright that we didnt pay cable and electric. Stupid under the table deal, I know.

Now they want their security deposit back. We (the people staying till next year since we renewed the contract) dont get the deposit back until next may.

So they want $91 from 2 people to make up for it. Not quite sure where they got that from....


So heres what im thinking.

Either they wait until next may when we move out (which logically makes sense) or I just dont give them the money. Why should I pay now?

And if I dont pay, I can just tell them that I used the money for the summer rent they owed since they broke contract. (And they're well aware of the fact they broke contract.)


I should probably also call my landlord to see if they actually broke the contract too...


So what do you guys think? Wait til next year until we get the money back, or just say screw you and move on?

This really doesn't sound like your problem. Can't you just tell them to get lost and take it up with the landlord?

Just tell them to talk to the landlord. Either way, I wouldn't give them any money.

Or Jep's idea. I think I like his suggestion the best. >_>

If you renew your contract and they don't then you have to pay your landlord the rest of the security deposit for the new tenancy. They should get their deposit back from the landlord at the end of their agreed year's tenancy. The only situation in which you wouldn't have to pay the deposit is if you are all no seperate contracts.

In Conclusion: Regardless of whether your old flatmates left early (they should have paid the rent, but there's not a whole lot you can do about it) they have now finished their tenancy period and therefore get their deposit back. In a normal situation you would have new flatmates who should be paying a security deposit equal to whatever your old flatmates are expecting back.

Yea like i said before, Ill give them the money (when i get it from the landlord) if he feels that they didnt break the contract.

If they did, im keeping the money to make up for the rent they didnt pay :P

just tell them that they ruined the carpet and the security deposit was used to replace it so no one gets any of it. (and then keep all the monies for yourself)
