Carrying a Pistol (JLee)

This is more for JLee but if anyone else can add, go for it.

So after watching some CSI last night I had two questions that popped into my mind.

-When you pull someone over, are they legally bound to tell you they are packing or that theres a gun in the car?

-If someone had something small like a misdemeanor that was technicially removed from their records, would they still be able to quality for a pistol permit?

I think it depends on state laws, but the only reason you wouldn't be able to purchase a weapon is if you are a felon.

But who is going to stop you if you go to a gun show

At a gun show they have to do a background check just like any gun store. The only exception is if its a private seller like if you were buying out of the classifieds.

The rules on carrying vary from state to state. I know here in Utah, I am required to tell the officer if I have my carry with me, whether I am wearing it or if it is in the car.

A misdemeanor in Utah typically will not prevent you from getting a permit. The big ones that will stop you would be a violent crime, a gun crime, or anything related like that. But again, it also depends on the state you live in.

There were a ridiculous amount of gun crimes in Rochester while I was there.

So many people wanted to test the theory that bullets bounce of fat.
Can't blame them for curiousity can you?

It depends on the state. Here in oklahoma, I do not believe you are required to inform an officer, but it's probably a nice thing to do anyway. I know a few people who generally just hand the officer their concealed carry card license with their driver's license and let the officer dictate how he would like to handle that.

The only things that keep you from getting a license here are felonies and violent crimes, especially domestic abuse. Or, having an unrelated crime on your record that you fail to mention. That's a big no-no.

As everyone else said- it varies by state. In NH, if you don't have any felonies and have no domestic violence related convictions, you're likely all set..pay your ten bucks and wait two weeks for your permit.

I don't believe that NH requires someone to notify law enforcement that they're carrying- it is a nice courtesy, though. Better than you tell me, even if I don't see it, than if I happen to see it without you telling me. Might make me nervous. :P

In WA you can't get one if you're a felon (and probably if you have any protection orders against you). I don't think you have to tell the cops, that would be awkward anyway... "do you know why I pulled you over?" "Yeah I was going 20mph over and I have a gun."

But when they pull up your license on their mobile computer they see in there that you have a concealed pistol permit. I was asked one time if I had any firearms on me and of course both my brother and I were packing. When we said yes it didn't seem to make a difference.

'Just so you're aware, I have a carry permit and my firearm is 'wherever''. Not mandatory in a lot of places, but as I said it's a nice courtesy. It doesn't bother me if someone is carrying, unless they want to shoot me...in which case they wouldn't tell me anyway. :P

I will see if someone has a permit if it was issued by us..but we don't have a statewide or nationwide database.

Every domestic violence order I've seen prohibits the restrained party from possessing any firearms at all, so that's an automatic DQ.

You can also just open carry without a permit. Tends to alarm the natives, though, depending on how far south you are..haha

indiana is fingerprints, background check, $10 for 3 year or $50 for LIFETIME, and i think the wait time is a couple weeks at the most... still haven't got around to getting one

also we have no laws prohibiting open carry but you still need the permit

i intend to... but i have nothing that would work too well for concealed carry... and buying a new gun is lower priority right now than new glasses and new front speakers for my HT setup

Get the permit now and the gun later. I doubt the permit will get any cheaper down the road. :)

Pistols are effectively banned in California cities. It's so freakin hard to get a permit.

http://en.wikipedia.org/wiki/Gun_laws_in_California#Concealed_Carry_Laws

Quote:
California law[10] provides that the Sheriff of a county or a city Police Chief may issue a license to carry a concealed weapon upon proof that the person applying is of good moral character and that good cause exists for the issuance[11]. While it is generally believed to be extremely difficult to obtain a license to carry a concealed weapon (CCW) in California, the difficulty varies greatly by city and county of residence[12]. In some rural counties, qualified applicants are usually successful in obtaining a license, while some cities and counties, such as San Francisco and Los Angeles, are extremely restrictive in what they perceive to be "good cause".

Quote:
Personal possession (i.e. carry) of a loaded firearm is prohibited in incorporated areas (such as inside city limits) or prohibited areas of unincorporated territory without a license to carry or other exemption provided for by law.[15] A license to carry "loaded and exposed" may be issued by a Police Chief or County Sheriff in a county with population of less than 200,000 persons at the last census.[16] No license or permit is required to openly carry a loaded firearm in unincorporated areas where discharge is not prohibited by local ordinance.
Despite these restrictions, there is no section of the California penal code that specifically prohibits open carry of an unloaded handgun (though possession may be restricted or prohibited in certain areas such as a State Park (CCR Title 14, Div.3, chap. 1, s 4313 (a), in a school zone (PC626.9) or federal properties like a Post Office or National Park (36 C.F.R. 2.4(a)).

Getting a shotgun or a carbine is easier, though.

I'm still waiting for mine. Sent it in at the beginning of February. It's killing me.

In FL I can theoretically do everything required for the permit, leave with it in my hand, then go to a shop and walk out the door with a new firearm all in the same day.
