Unfortunately LucasArts would probably not let him (them?) make an actual game out of it, should they choose.

Depends. I think they don't like you directly taking assets from games. Like directly ripping music, textures, etc. Probably wouldn't be a problem going from an old version of Monkey Island to the Crytek2 engine.

No, it's not about assets. It's about the copyrighted story material. If a fanmade Monkey Island game is released, it potentially takes sales away from future Monkey Island titles from LucasArts.

Square Enix did the same with Chrono Trigger remake some group was doing. It didn't make use of any old game materials, except of course the storyline and likenesses. But that's still more than enough to be copyright infringement and they enforced it strongly.

That being said, shutting down mods is generally harmful to a company's image. Groups like Valve understand the value of mods and encourage them to flourish, even if they infringe upon copyrights (like most do, technically anyways).

It's only really harmful if a significant portion of the company's customers know about it.

Actually more like re-releases of the classic game in the future. That's what most shut down re-make mods have been shut down for methinks.

Yea the story and the music will probably be a legal issue and so will the art too (:/) because they are basically just using the 2D art as textures/materials. I thought they were just making their own shaders but yea they're using the original art. Which looks cool. But that's bad. And counts as stealing.

Because the CryEngine 2 can't handle realistic fruit and tasty edibles. It is simply out of capabilities of the engine.
