We need JLee in here. I didn't think indecent exposure applied to private property. What about those that sun bathe in the buff in their backyard? Can they be charged if someone peaks over the fence at them? What about nudist resorts/neighborhoods?

It won't go anywhere. Accidental exposure is ok, they need proof that he *intended* to expose himself to people, i.e. it has to be proved to be deliberate to be a crime.

Walking around your own house making coffee at 5:30am isn't deliberately exposing yourself to someone - well I hope not anyway <_<

Why wasn't the woman charged for invasion of privacy? Why was she looking in his window anyways? If the genders were reversed in this event, would the nudist have been the one to get arrested?

The police seem to think he was intentionally giving a show.

It's one thing to get spotted walking past the window naked. it's another thing entirely if he's sitting there in front of the window waving at people going past. (it doesn't say he was waving, but you can get the impression that he was aware she was there and was enjoying the attention.)

she was walking through his front yard and looked into his window... it's not hard to not notice someone walking through your front yard when you're having breakfast

Okay, so if I was bringing my kid to the bus stop and we saw a naked guy in the window, EVEN if he was standing there with a smile on his face, I'd just tell him to look away and keep walking. Are people so sensitive that EVERYTHING has to turn into a legal battle?

One time there was a crazy naked man masturbating in the ruins of this big burned down mansion on the hill. My Mom, Grandma, and me were driving by and all 3 of us started gut-laughing. I was only 11, but it wasn't that big of a deal, and was more confusing than anything.

My wife & I spend the majority of our evenings naked. We also enjoy the natural lighting that our apartment windows offer. We use sheer curtains so that we still get a decent amount of natural light while also blurring the details for passerby's. We've had a few children stare through our windows because our cats like to sit on the windowsills but other than that we've never had any problems. I think that most intelligent people aren't going to make a fuss if they see you naked in your home as long as you're not putting on a public sex show. I personally think that people that have a problem with nudity have something stuck up their asses & are probably equally afraid of their own bodies. Maybe it stems from the whole Adam & Eve thing.

I think there is more to this story than the initial reports would have you believe.

It's been my experience that small but important details that show authority figures such as the police in a better/more positive light are often left out of stories such as this one.

Yeah, a mentally challenged guy was standing naked on the second floor of the half-burned down stone castle/mansion, facing towards the road masturbating. Several people had seen him that day, it was on the news that night. He was eventually caught and they found out he was retarded, but had no connection to the building burning down. One of my strangest childhood memories because it was so simple and clear. Just a naked white guy going to town on himself for the hillside to see.

Several things.

It was 5:30 AM, that is, before the sun came up.
Two. In order for her to see him, the lights inside had to be one.
Three. It was most likely dark in his yard.

If the inside is bright, and the outside is dark, you cannot see out a glass window : It becomes a one-way mirror.

So. The man most likely could not have seen her even if he had been looking. Second, what the hell was she doing outside, trespassing, with a seven year old, at 5:30 in the morning?

I got the impression from the guy's interview on the local news (Don't know if it's the same one I linked; I didn't watch the one I linked) that he didn't even know the woman was there until the police knocked on his door.

this is kind of what I was getting at with my first post.
Then again maybe it did happen like he said.

But also, it's not really a big deal for her to be walking in his front yard. At my old house I had a relatively small front yard and none of the yards on the street were fenced. people walked through the yard all the time. (I still walked around my house naked) :o.

Also, I spend a lot of evenings in my underwear or less when I'm at home. I tend to dislike wearing clothes unless it's too cold otherwise.
