Legal Question Concerning Rentals
2004-08-30, 4:16 PM #1
Hypothetically, let's say someone sets up a business in which the customer can rent a controller from the owner to play in an XBox LAN for a paid amount of time. (Note that this would be a professional venture, and not just something the owner is setting up in their basement.) What sort of legalities would one have to go through in order to do this? Would it require some sort of written agreement from the owners of the game that is being played as well as Microsoft? Would it also require paid royalties to said companies?

I wouldn't think so. If you own the controllers, you can usually do what you want with them, and that includes renting them out.

I don't think Blockbuster pays royalties to any of the console comapies for renting their games out. They buy them and rent them out to people.

Yeah, I think you have to pay the game publishers extra if you are using the game for a rental, but I don't see any issue with the console itself. Talk to a small business lawyer or something, because it could get sticky.

I assume if you rent out video game stuff there's gotta be some royalty involved or something... but don't look at me, I'm no lawyer...

I know there exists higher prices on movies for rental places (for instance, only rental places had Final Fantasy on VHS when it came out, and this was because the VHS copy was $200 a pop).

what wolfy said... when rental places buy the copies of the movies they pay considerably more per copy than the normal price... for obvious reasons
