If there were a legitimate chance of someone establishing their own Internet service provider, thereby discouraging network traffic prioritization through the threat of loss of business, then I would agree that any significant presence of the government could be more harmful than beneficial, but, as there is no such thing as market forces pressuring providers to not screw over their customers, then a third party is required to oversee and protect the consumers of ISPs.
