Well, 'footlong' isn't really part of the English language. The words foot and long are two separate words.
So if you want to sell foot long sandwiches, fine, but footlongs? I can't see them winning their case against Subway.
Yes, it's a tiny little nitpick technicality, but that's what copyright law is all about.

its just kind of rediculous if they are able to copyright a word that is pervasive throughout the food industry. its NOT something they created or coined. and it is not unique to their marketing. i mean i could see if they wanted to copyright the whole phrase "5 dollar footlong"
