The law is unjust. Accurate ratings are good for a game companies image, the only thing a law does is add government intervention where it shouldn't be.
I'm glad we have government to regulate images instead of parents. It's almost like someone downloaded a mod that unlocks WMD in Iraq.
I anticipate the following arguments:
< it's the law. Change the law, don't complain.
Laws can't be challenged until they're recognized as such. Most likely attorneys will work something out and the law will stand. I'm sure the law is constitutional for the same reason as "minors can't buy porn" is.
< Government has a responsibility to keep images out of the hands of children.
Why? The game already has a Mature, +17 rating as is. A modification means the game is altered, which would mean the game + the modification isn't anticipated by the rating. I don't think Rockstar should be held legally responsible for the downloads of their customers that adds content to the game.
And what if they don't regulate games? Like I said, it'd be bad for the company's image to not be rated. That's bad for business. There's practically no profit incentive to them keeping it secret, since parents let their kids get the games anyway.
You might persuade me if the game had porn they didn't account for in the actual game, but when it comes to putting a company on trial for a modification that may or may not have unlocked HIDDEN content, there are better uses for our court system.
I haven't done any research on it though. I'm on vacation so I'm not planning to search Lexis for the sake of a Massassi discussion. Just don't burninate Rockstar without looking into it first.
