Yes, cause nothing like a couple of guys maybe modifying a COMPUTER game to display nudity? And after all, you can kill people in so many ways in that game, including taking out enough people to take out everyone in LA, a little nudity is really that much worst?
I can't think of anything to put here right now.

Did anyone even PLAY Vice City? Sex scenes galore.

And WHY is this bad? The game isn't FOR little kids so WHY is a FAMILY BOARD announcing an ALERT to FAMILIES! "PROTECT YOUR KIDS AGAINST WHAT THEY LEGALLY CANNOT HAVE!"

Because they broke the law. They included content that, while not meant to be in the full game, was not covered by their rating. Technically it should be AO with nudity and sex scenes listed on there. And no, it wasn't so bad in Vice City as it is in the Hot Coffee mod. Trust me.

Maybe, but Rockstar still broke the law. They included sexual content in the game without saying so in the ESRB rating. The mod just unlocked said content, not added it.

One could argue that they didn't really include it in the game if it was completely inaccessible in any way. You need the mod, which is third party. The fact that they included it doesn't necessarily mean it was in violation because it was completely inaccessible to the public playing the game.

Maybe Rockstar forgot to completely remove those missions when it decided to take them out of the game.

How did the brake the law? Don't game companies volentarily give their game to ESRB? Rockstar included sexual content that couldn't be unlocked by regular means.

Game companies voluntarily give their game to ESRB like movie companies voluntarily give their movies a rating. With the game ratings starting to be legally enforced now, it's quite important to have spot-on ratings, too. The last part is something that may or may not save them in court.

As far as I'm concerned, a mod could have just as easily added the content by itself. It doesn't matter if it's in the game or not, it's not accessible to the user without third party means, so it shouldn't affect the ESRB rating. It's no different than downloading a mod that added all the content on its own.

Thats like saying Jedi Knight should have a Mature rating because you can make a mod with nudity in it. Its all about the user behind the monitor.

I'm guessing that the content was not actually in the original game, and is added by the mod. Journalists and reporters dont quite properly understand the concept of a "modification" and the article is consequently misleading.

That being said, this is nothing new. I remember a mod for RTCW that made the female commandos naked, and I know there were similar mods going back as far as Doom even.

Pretty much every semi-popular game in recent years has had some such "modification" made for it. Heck, even JK had a few run-ins a while back... 0_o

No, Rockstar LEFT the content in the game, the mod unlocks said content. Only the courts will decide if that should have counted for the rating, thus deciding if they have broken the law. (Directed generally at DS and SF Gold)

The law is unjust. Accurate ratings are good for a game companies image, the only thing a law does is add government intervention where it shouldn't be.

I'm glad we have government to regulate images instead of parents. It's almost like someone downloaded a mod that unlocks WMD in Iraq.

I anticipate the following arguments:

< it's the law. Change the law, don't complain.

Laws can't be challenged until they're recognized as such. Most likely attorneys will work something out and the law will stand. I'm sure the law is constitutional for the same reason as "minors can't buy porn" is.

< Government has a responsibility to keep images out of the hands of children.

Why? The game already has a Mature, +17 rating as is. A modification means the game is altered, which would mean the game + the modification isn't anticipated by the rating. I don't think Rockstar should be held legally responsible for the downloads of their customers that adds content to the game.

And what if they don't regulate games? Like I said, it'd be bad for the company's image to not be rated. That's bad for business. There's practically no profit incentive to them keeping it secret, since parents let their kids get the games anyway.

You might persuade me if the game had porn they didn't account for in the actual game, but when it comes to putting a company on trial for a modification that may or may not have unlocked HIDDEN content, there are better uses for our court system.

I haven't done any research on it though. I'm on vacation so I'm not planning to search Lexis for the sake of a Massassi discussion. Just don't burninate Rockstar without looking into it first.

Bottom line is Rockstar failed to disclose the nude models were left in the game data. In this way they broke the law and they should be punished. The same thing probably would have happened in Max Payne 2 (about the nude Mona model) if MP2 had sold better.

For the record, the ESRB ratings are not the law. A minor can, perfectly legally, play an M rated game, the same way they can legally watch an R rated movie. Some stores won't sell the game to kids, sure, but a minor can just as legally play GTA as anyone here can.
