My job sucks and my boss might be talking behind my back

So yeah, I've been turned down for 2 job interviews which I was more than qualified for (Especially since I got family who is in management at ONE OF THE JOBS) and had 2 more important jobs refuse to even call me.

I realized that I think that my managers at Cracker Barrel are talking bad about me behind my back. So my friends and I decided to do a little test.

See, my friend Michael is gonna call up and say something like "I am the campus technology manager at such and such elementary and Scott interviewed" basically act like I am trying out for the job and see what the manager says about me.

Then my friend Chris, who owns his own business, has "recieved" my resume. I handed him one and he looked over it. Anyway, he is going to call and ask them some questions and record it, that way if the manager is talking trash about me behind my back, I can take them to court. After all, Chris IS in fact a business owner and I could in fact move down to Austin and work for his company if I wanted, and he has read a copy of my resume.

So what do you think should be some good questions to ask?
I can't think of anything to put here right now.

Questions about your performance, work ethic, personability, competency, work habits, whatever.

Any reason why you have to use your boss as a reference? How about asking the interviewers NOT to contact your current employer? It is your right.

It looks really bad though if you say that. My last choice is to talk to this private school owner and use her as a reference. I've done some volunteer work for her, and having a private school OWNER give you a positive reference is great.

Dude, it is INCREDIBLY ILLEGAL[/i] for your manager to say ANYTHING behind your back to a potentional emplyoer beyond the following:

What was his hire date?
What was his termination date?
Would you rehire him?

If they say "Personally I found him to be lazy" that is ILLEGAL. They can only call to VERIFY EMPLOYMENT and ask if they would rehire them. They can NOT give any specifics about performance AT ALL.

I MIGHT BE OUT OF MORE THAN 4 JOBS BECAUSE OF THIS MAN. I might be submitting my resume and interviews and NOT BE GETTING A JOB because of him.

Jesus Christ, just leave this thread.

No, it doesn't look bad at all. Explain to them that you don't want your employer to know you are looking for another job, lest you be fired. It's common courtesy. If they violate that request and you do get fired or your boss gives you a bad rep, then you can sue.

Know your rights.

You people are so pathetic. Ok, just 2 of you.

If you can't get a job because a previous employer is lying about you, think back to this. I could be making an extra $10,000 a year. And that would be enough money to get me out of this house and away from my mother.

So look at it this way: For now on, if I continue to get denied these jobs, I will be posting a new thread about my mom. Why? Because I will remind you that I can't move out because I can't get a better job.

That's a bit different than talking about you behind your back--I didn't discern that he was doing this to possible employers. Why don't you just take him off your resume if it's so bad? I mean, honestly.

And who's to say the positions weren't open, or they just weren't interested in you?

DJ Yoshi, there is a HUGE SIGN outside CarMax that says "Now hiring sale consultants."

My brother Corey is a manager there.

My brother Greg is a manager at Car Max.

My father is a manager at Car Max.

Each one is in a different department (in Greg's case a different store but he worked at this one originally) and I was never going to be seeing any of them while on the job unless I walked through the entire store looking for them. Hell Corey is in a totally seperate building.

I am more than qualified for these positions.

And I have a THREE YEAR employment at my current company. That is a major frigging gap to remove off a resume.

Um...just one tiny, itsy bitsy, baby question here: Isn't it illegal to record someone like that and that he could techincally turn that around on you if you did take him to court?

Yeah, recordings are inadmissable in court. The law requires all parties being recorded consent to said recording.

That's kind of a "duh" thing. Would he be complaining if his boss bad-mouthed him to his friends? Doubtful, because that's not likely to influence his career. Sure, it's gossip, but gossipping to people that don't effect your job wouldn't matter much except in public image, but that's a COMPLETELY different thing now isnt it?

Then sue the manager for touching me today twice on my shoulder using force.

Works for me.

I have about a half dozen different law suits I can bring against the company, ranging from the blantly racist practices (Yes Cracker Barrel IS very racist) to the public sexual harassment between both management and employees to the laws they broke regarding breaks.
I can't think of anything to put here right now.

Can you prove these beyond a reasonable doubt? Your boss will have no problem proving his case against you, since he would have the recording.

Maybe I'm misunderstanding you or the system, but if it's illegal for him to disclose his opinions on you as an employee, then how can he be your reference?

Because the key question is this:

Would you rehire this person for employment?

If they say YES then that is a good reference.

If they say NO then that is a bad reference.

If my manager is saying just "no" I fail to see why he won't just fire me. I've had managers before who literally had something against me, and I could NOT use them as a reference as a result because they didn't like me personally. No matter what, I wasn't "Good enough" in their eyes. So I might not be good enough in James' eyes, but I might be in another's eyes.

Only a dozen states require both parties to consent to a telephone recording. Texas is not one of them.

And even in states where it is illegal, I don't think it's tortious, just inadmissible in court.

my friend who has his own business would be able to testify. That would be a witness.

And this is the only manager who hates me. Problem is they call and ask to speak to the GENERAL MANAGER and he is the one, and he is the problem.

Only had like 2 other managers who hated me personally.

I think you'd need more than one witness to prove your case. Especially considering the person is your friend.

Alright, I told my brother to speak to Car Max and find out why.

And combine that WITH the recording, WHICH BTW while may not be "inadmissable evidence", if played, it's heard. Even if its thrown out of court, my friend saying "That was me on the tape" would be proof.

According to his profile, THRAWN lives in Texas. As I said before, recordings require only one party's consent in Texas.

The admissibility comment clearly refers only to states in which such a recording is illegal.

Maybe I'm just a cynicist, but you ***** way too freaking much. You didn't get 4 jobs: Deal. Don't put him on your resume, if you think he's bad mouthing you.

You seem to play the victim card whenever at all possible, and don't like admitting to anything at all ever, and because of that, are stubborn enough to lose more than you can possibly gain at all.

Try taking things as they come and finding a way OUT of situations, instead of finding a way to CONTROL the situations.

And usually, from my understanding, employers don't call the references until you've had an interview either. Of which you had none (two turned down - two didn't call.)

I guess I've been lucky. I usually manage to find a job by my 2nd or 3rd try.

Exactly. Just because you have an "in" at the company, doesn't mean you'll get the job. And just because you assess yourself as overqualified doesn't mean someone else feels the same way. I think that your calling us pathetic, assuming you can level a law suit (let alone win it). amd assuming that you were wronged is all indicitive of some grand sense of entitlement that may be entirely misplaced.

And employers only check references after an interview.

1) An employer can justify his yes or no answer. If he says no, he would not rehire you, it is within his right to let the potential employer to know why. Maybe it's not reason enough for the potential employer to not hire you.

2) If you are fired, most employers are required to pay unemployment.

First of all.

Nepotism is weak. The fact that you EXPECT a job because relatives work at a buisness is weak. Where I come from, you EARN things, and don't expect an easy way in.


It is SO not against the law for an employer to justify an answer. And even then, if your boss is bad mouthing you, you did something wrong. Working for someone isn't magic happy candy land. You have to kiss ***, and you have to work to someone elses standards, and bend to their curves. Pissing, moaning, and being a whiny little snot isn't going to get you anywhere.

Suing a previous employer because he thinks you suck and told a future employer is ONLY going to make you look bad. I mean, thats some whack stuff to put on a resume.

Any good job requires a complete background check, and they're going to know everything. I know I wouldn't hire someone after they sued a previous employer.

Agreed. If I wanted to be employed at the same place my mom works, the best mom is going to do is tout my abilities. I'm still going to have an interview. If I'm not qualified in the employer's viewpoint, then that's it. I cannot force my way into a job which what seems the OP wants to do.

It is not "incredibly illegal" as you say, bad taste, yes, but not illegal. You just wish it were. Face it, if people don't like you or your work abilities, people are going to say that and sometimes with malice esp. if you cost company time/resources. And quite frankly, I hope they do. If I, the employer, come across you the potential employee. I want to know EVERYTHING about your past jobs. If you were an abomination at your previous job, I need to know that.
