A pyramid scheme involves people paying those above them, who then in turn pay those above them. This is multi-level marketing -- the people you refer aren't paying you directly, and thus, no pyramid. You don't get more for each person under you -- all rewards at set.

It still assumes the existence of infinite numbers of people who might eventually sign up... if it takes five people for one person to get an ipod, then it takes 25 people for those five people to get one... then 125, 625, 3125, etc. Somewhere along the line, there just aren't enough people left.
